Thank you for showing an interest in our Unreal
Tournament 2004/2004 Modification. While we may not be a BIG
company, we are still dedicated BIG time to creating a great
video game.
This website is a collaborative environment for
students, hobbyist and veteran game developers, who want to make
a great game. By teaming up with others dedicated like

Our goal is to create a professional quality Mod of THE Devils
Own for the Unreal Tournament series, then continue and produce
a complete stand alone game.
Note:
We are seeking programmers, 2D and 3D artist, level designers,
writers, sound programmers, and web designers. This project is
a collaborative work. The UT2K3/4 modification will be owned
by those who help make it.
LEGAL STUFF (posted March 18th, 2004) READ
ME BEFORE SUBMITTING WORK TO DEVILS OWN UT MODIFICATION.
I.
By submitting your work (programming code and/or 2D/3D art) to
this collaborative project to make a Napoleonic Unreal Tournament
2004/2004 Modification (refereed to as "Mod"), you
are agreeing to the following:
1.
We are organized as a collaborative effort, with people donating
their work ( programming code and/or art work ) to a non-commercial
mod. Contributors retain the rights to their work, with the understanding
that you are
sharing the non-exclusive right to use your work in the Napoleonic
mod. You will receive credit for any work used in the release
of the mod, and it will be a game you can play and/or show to
friends, family and potential employers. No limit is placed on
you being able to use your own work in other projects. Work contributed
can be converted and changed to suit goals of Mod project. The
mod will also be entered into Unreal Mod contest in order to
help promote all our efforts ( It would also be nice to win something).
( example: Peter E. of the New England Fife and Drum Corps
has agreed to allow us to use some of their music in the Napoleonic
UT2K3 mod, with the condition that it is a non-commercial, not-for-profit
game and that we give the band full credit, with the clear understanding
that the band retains the rights to music and if we or others
want to use their music in another format, then the band's permission
must be granted.)
2.
We plan to enter Unreal Mod Contest.
Of course we will deserve to win.
So if we do, then who gets the money?
The Unreal contest rules state, one team member from the mod
will be given the prize(s) and it is up to him to distribute
the winnings. Everyone who has helped make this mod will be given
credit. I will be the one representing our Devils Own mod.
I will be the final judge and jury on handing out any prize(s).
If the Mod wins a category, then between 60% to 75% of winnings
will go to person(s) who made and contributed the winning item(s).
I will ask the main person who made the item(s), who and how
much help (percentage wise) was received from others, then I
will ask the other person(s) named by main person if they agree.
This is were I will be as fair as possible, with distributing
a proportional amount of the 60% to 75% prize to those involved
in making winning item(s). The remaining 25% to 40% of the winnings
will go to group members who did not receive any part from the
60% to 75% share ( divide amount by number of Active Members
and Mod Contributors Shares and distribute shares according to
level of participation, see below for details on shares ). If
we win a physical prize (ie.computers), then the prize will be
auctioned or sold and the cash will be distributed same as above.
If we win cash for overall Best Mod, then we will divide winnings
among all the individuals listed as either active members and/or
mod contributors in the game credits of the winning mod demo.
We will have Active Members (1stSquad@6shares, 2nd@4shares and
3rd@2shares) and Mod Contributors (large@3shares,medium@2shares,small@1share).
The most active team members and large mod contributors will
receive three times as much as the least member/contributor,
with similar ranked active members receiving twice as much as
similar ranked mod contributors. People who offered advice, help,
support, and/or donated material that was not used in actual
mod, will receive a "Thank You" on credits page, but
no share of any winnings. I decide what level of participation
individuals are working at, with the understanding that ranking
may change. If we win Unreal Engine License, then it is agreed
that we will continue to develop a commercial game (Napoleonic
or other theme). If a team member does not wish to and/or is
not asked to continue with developing a commercial game using
the UE License, then any work they contributed to the Mod will
not be used without their permission, and the team member will
be paid between two-hundred to one-thousand two-hundred US dollars,
according to level of participation. Each individual will be
responsible for any taxes due on their share and any prize winnings
distributed will have the taxes subtracted and paid to tax man.
My name will be on any prizes given to our mod team, so the tax
man gets his share first. Then the remaining award is divided
as described above. (Chances of winning may be small, but I wanted
to spell out a fair way to share any prize.)

- My (James Finn) goal is to eventually make a commercial stand
alone Napoleonic game. If I had the resources, I would recruit
a paid team and make it right away. But since funding is low,
taking a freely available professional game engine like UT and
making a playable demo version of the Napoleonic game is the
next best thing. In the future, I hope to make a stand alone
commercial Napoleonic game, but would not use any Devils Own
donated material with out the permission of the person(s) who
made material.

- Mediation and Arbitration Clause
In the event a dispute shall arise between the parties to
this agreement, the parties agree to participate in at least
four hours of mediation in accordance with the mediation procedures
of United States Arbitration & Mediation, Inc. The parties
agree to share equally in the costs of the mediation. The mediation
shall be administered by the offices of USA&M Midwest, 720
Olive Street, Suite 2020, St. Louis, Mo 63101, phone: 314-231-4642
(If USA&M Midwest not available, then successor company.
If n/a, then similar service.)
Mediation involves each side of a dispute sitting down with
an impartial person, the mediator, to attempt to reach a voluntary
settlement. Mediation involves no formal court procedures or
rules of evidence, and the mediator does not have the power to
render a binding decision or force an agreement on the parties.
If Mediation fails, then the following:
In the event a dispute shall arise between the parties to
this agreement, it is hereby agreed that the dispute shall be
referred to United States Arbitration and Mediation, Midwest,
Inc. for arbitration in accordance with United States Arbitration
and Mediation Midwest Inc. Rules of Arbitration. The arbitrator's
decision shall be final and binding and judgment may be entered
thereon.
In the event a party fails to proceed with arbitration, unsuccessfully
challenges the arbitrator's award, or fails to comply with arbitrator's
award, the other party is entitled of costs of suit including
a reasonable attorney's fee for having to compel arbitration
or defend or enforce the award.
THIS CONTRACT CONTAINS A BINDING ARBITRATION
PROVISION WHICH MAY BE ENFORCED BY THE PARTIES.
II.

If you do not agree to the terms stated above, then please do
not submit your work for use in Devils Own UT2K3/4 Mod.
2.
If you are under 18 years of age, then please have your parent(s)
agree to the above terms, before submitting work(s).
3.
If you have any question(s) about the above agreement, then please
ask.
